You’ll be known as ‘Intestate’ and ‘intestacy’ are the legal terms used to describe when a person dies without a legally valid Will.
The ‘rules of intestacy’ are a set of laws in England and Wales that guide what happens to a person’s estate when they die without a valid Will. Under these rules, only certain close family members can inherit from the deceased and in a very strict, inflexible way.
Who inherits is determined by a fixed set of criteria depending on your marital status and whether you have children.
Another consideration is the fact you’ll leave loved ones guessing about your wishes, for example your funeral preferences and any gifts or messages you’d have liked to leave.

Remember that debts, fees and taxes will need to be paid by your Estate before any remaining money (known as your residual estate) is paid out to those your select as beneficiaries.
We recommend appointing guardians for your children, who’ll be able to look after them if the worst happens. This gives you complete control over who you feel would be best suited to bring them up. You can select up to four guardians. They must be over the age of 18 at the time of writing your Will.
You can also make provisions for your children in your Will, such as leaving gifts such as money, vehicles and jewellery as well as making them a beneficiary of your residual estate (everything that's left after debts, taxes, funeral costs and gifts).

By making a Will, you can decide who should care for your pet in the event of your death. In the same way you can appoint a legal guardian to take care of your children after your death, so it is possible to name a legal guardian for your pets in your Will.
When naming a guardian for your pets, you should also consider the costs associated with passing on a pet. Some clients therefore choose to leave a cash gift to the guardian to help the new owner cover the costs of feeding and caring for your animal.
If you do not make a Will, or you make no formal arrangements in your Will for your pet, it is down to your family or friends to try and make provision for your pet after your death. This can put them in a very difficult position and lead to a potentially undesirable, difficult outcome for both your pet and their new owner.
